Carl and his wife Tiffany, Sarasota homeowners facing foreclosure, recently called me for help with avoiding foreclosure.

- They called their mortgage lenders (actually the servicers of their 1st and 2nd mortgages) for help modifying the terms of their mortgages to help them keep their home.
- They called HUD (Housing & Urban Development) and begged for help from a HUD counselor.
- They tried local mortgage professionals advertising themselves as “loan modification experts.”

SCREAMS FOR HELP GO UNANSWERED
Carl & Tiffany, like many other struggling homeowners with whom I talk, are facing (documented) financial hardship. Both have jobs (fortunately) but both have lost hours and income.
They don’t know how stable their jobs are, but they need to try to keep their home.
Qualifying hardships are supposed to include:
•Something has changed and you are worse off
•Adjustable Rate Mortgage going to or already has reset
•Payment will be going to principal and interest from interest only
•TAXES went up
•Income is delayed
•Illness
•Loss of Job
•Reduced Income
•Failed Business
•Job Relocation

Desperate for help, Carl & Tiffany purchased a DIY Loan Modification “kit” from a website “…filled with success stories,” according to Carl & Tiffany.
Carl & Tiffany did NOT read the Return Policy, which according to them promised 100% Satisfaction Guaranteed. For reasons unbeknown to me, this program did not work for them & they requested a return of their money.
NOTE: I intentionally am NOT including the company’s name or website simply because I have NO independent verification the company’s product did not work or that Carl & Tiffany actually utilized the program…or utilized the program as instructed. In fact, I don’t yet know WHY loan modification did not work for them. They called me to SHORT SELL their home, helping them avoid foreclosure. The intent of this article is to beg you to READ CAREFULLY all return policies before spending money on a hope and a (WEAK) promise as you will see below.
Here’s what disgusts me – even though I acknowledge the company’s fears. The company does not want you utilizing their product successfully, only to return it for a full refund.
Whether or not you know it, I provide DIY bad credit repair help - YES, I have people demanding a refund after copying or not even attempting to implement these proven credit improvement secrets.
Bottom line: Not every customer is honest. A merchant cannot, in my mind, punish all customers (or the merchant him/herself) for a few bad apples.
In fact, I believe a CUSTOMER-centered return policy increases sales! What you see below is a BAD return policy. It’s the Return Policy Carl & Tiffany did not read…at all.
Instead, they fell for the 100% Satisfaction Guarantee notice plastered on every page leading to the order now button.
Refund Policy
100% Satisfaction Guarantee.We want you to be satisfied with your purchase. If there are ever any problems with an order you receive from us or you wish to return or exchange an item don’t hesitate to immediately email or call us to resolve the problem and get a Return Authorization number (RA) for your merchandise.
To receive a Refund for merchandise less S&H, we must issue an RA Number no later than 14 days from the date of purchase. Due to the custom product and immediate nature of the customer support services provided by (company name removed)., any cancellation and return made after the 14 day cancellation policy is non-refundable. Additionally, we must receive the entire guidebook, CD, and all original shipping packaging in new condition no later than 21 days after the date of purchase. (emphasis added by author)
All shipping charges that apply to the return or exchange of merchandise, must be paid by the customer. All returns and exchanges must be shipped prepaid and include a return authorization number (RA) on the outside of the box and must be shipped insured with payment for re-shipment on exchanges. All Returns MUST have a Return Authorization (RA) Number and be Received Back in the Original Packaging or they will not be accepted by our Shipping Dept. They Will be returned back to you with No Credit Issued.
If within 60 days of merchandise purchase home is foreclosed upon, you will receive your money back. Please provide evidence of notice to quit property issued by the sheriff and you will receive a full refund. Notice of sale and any pre-foreclosure documents will not be treated as proof for refund.
Misleading and/or deceptive business practices (should) hurt business people as much as it does consumers like Carl & Tiffany. If I were consulting with this company’s owner who supports this deceptive return policy, I would insist a consumer be prompted to read the return policy before being allowed to purchase.
As a real estate agent who helps homeowners avoid foreclosure and a consultant who helps small business owners in and around Sarasota increase PROFITS using the Internet, I do not believe in deceptively (appearing) practices. If people really find value in a product and they really believe it will help them (and it should) then prompting prospects to read a return policy BEFORE they purchase will (should) not affect sales.

Sarasota foreclosures demand LEGITIMATE foreclosure prevention, whether attorneys, mortgage professionals and/or DIY programs/products. Why the mortgage servicers could not (would not) help Carl & Tiffany doesn’t surprise me. I myself witness this disgusting reality. Why the HUD counselors didn’t help Carl & Tiffany also does NOT shock me especially once I discovered who really is on the phone as a “HUD counselor.” The time-tested adage exists for a reason: “Buyer Beware!”
