Sarasota Foreclosure Prevention – Help Please!
Description: Sarasota foreclosures – In and around Sarasota, Florida, foreclosures have become a higher percent of sales and inventory.  In another staged preventative foreclosure action, Bank of America, recently joined by other big banks, openly has agreed to principal reductions.
What is “principal reduction,” you ask? 
How are principal reductions “fair” or to be implemented? 
What repercussion (both good &amp; bad) will principal reductions have? 

Non-distressed sellers find it difficult to compete with distressed properties.
Compete, you ask? Why should there be competition with distressed  properties?
Wouldn’t a buyer prefer a non-distressed property, free from all the short sale and “reo” (aka “real estate owned”) chaos?
Great questions.
Sarasota foreclosures pull down prices of non-distressed properties….
Here’s the issue befalling many sellers of non-distressed properties: distressed properties are dominating sales. Valuation experts, who do NOT want to include distressed properties in valuations, now must include distressed properties.
Enough “normal” sales are not occurring to serve as comps, even when valuation experts go outside their usual 1-2 mile (or neighborhood) comfort zone.
Sarasota foreclosures continue pulling down prices, even for non-distressed property owners who stand by as (any) remaining equity slips away.

Indeed, some tenants unfairly are being taken advantage of by unscrupulous property owners and their agents (leasing agents, landlords, etc).
In fact, just the other day I heard from an active military guy serving in Afghanistan. His wife and children are in Orlando; he’s a million miles away, fighting to protect us.
Yet, he contacted me out of fear for his family.
He’s discovered by chance the house he and his wife THOUGHT they were renting to own really is in default – property owner took their $6,000 or $7,000 upfront option payment (I don’t recall which it is).
Worse (in this guy’s mind anyway) is that this owner NEVER once contacted him or his wife about default. He’s been taking their money each and every month.
GREED &amp; Entitlement Define Many Defaulting Landlords
For sure, greed is the day’s four-letter word.
They screwed me (banks). I’m going to screw you (landlord to tenant). In this case, they (landlords/property owners) really believe two wrongs make a right.
Having said this, I DO see what’s happening….
But then, (some) RENTERS force landlords into foreclosure…as well!
But it’s not just happening with landlords putting the screws to tenants. It’s TENANTS also forcing property owners/landlords into foreclosure!
It’s tenants using the the clogged courts, penniless (distressed) property owners &amp; (some) greedy attorneys who checked their conscience at the front office during law school matriculation to FORCE owners into foreclosure.
Yes, I’ve experienced this with a**hole tenants who squatted in the house after contracting to BUY this very house. They went under contract and then proceeded to buy another house, apparently knowing the owners/sellers could not afford to pursue justice.
Horrible what they did…buying another house while under contract.
Worse, they squatted and wouldn’t get out to allow us to try to find another buyer. Hell no, these people squatted, forcing one school teacher and her county government husband (who’s hours have been cut and job in jeopardy) into foreclosure. As long as I live, I NEVER will forget this abhorrent behavior.

Sarasota homes for sale tell stories unlike any painful, tragic, joyous stories you’ve ever heard. Working the front lines, I see more than I care to see. I see human nature at its ugliest; I (fortunately) see human nature at its most selflessness. Sarasota Foreclosure Danger Finds “HOPE”!
Description:  Sarasota foreclosure forces homeowners to fight  back, using whatever available government “alphabet soup” program!

HOPE, HAFA, on and on….
The latest “foreclosure prevention” incarnation comes from Bank of America at the bequeath of the FEDS.
Bank Of America seeks redemption but what else?
Bank of America is considering offering unemployed homeowners who cannot afford their mortgage payments a full 9 months of forbearance while they search for (and secure) a new job.
Definition: Forbearance is a special agreement between the lender and the borrower to delay a foreclosure. To avoid foreclosure, the lender and the borrower can make an agreement called “forbearance”. According to this agreement, the lender delays his right to exercise foreclosure if the borrower can catch up to his payment schedule in a certain time. This period and the payment plan depend on the details of the agreement that are accepted by both parties.
If during the nine months the borrower is able to obtain employment,  Bank of America pledges to structure a mortgage loan modification based  on the borrower’s new income. Nine months appears very generous.
Borrowers who fail to find new employment within the forbearance period  would be required to relinquish the home through a deed-in-lieu transaction
Of course, this is a proposal: we’ve not yet seen all the final version to search for the fine print or gotchas, which naturally beg a few questions (and answers):

If borrower cannot afford the modified payment after forbearance, is borrower FORCED to surrender deed?
Will BOA forgive deficiency – providing full payoff and satisfaction, thus restraining the rapid debt collectors from chasing these people for up to 20 years in Florida?
How will BOA report to the BIG 3 credit reporting agencies?
Does borrower relinquish rights to redress wrongs, perhaps after a forensic and compliance audit for instance?

Questions…questions. On the surface, NONE of these programs have come close to living up their (hype).

Sarasota foreclosures seek hope but expect more ado about nothing…aside from the something the bank expects. Still, we must look forward to any and all programs or proposals offering to help homeowners keep their homes (or at least try to keep their homes).

Home buying takes place on emotion, not logic.
Combine emotion with lack of experience buying (or selling) Sarasota real estate and costly mistakes occur.
In many articles I’ve shared experiences I’ve had with buyers emotionally “in love” with a house, suspending all logic – even when costly structural issues exist. If you’re looking for a realtor who will swoon and “ah” at every house you see, I’m not your realtor.
You can swoon; I will examine the value and everything else that helps you get the best deal possible, not just today but hopefully years to come.

My responsibility to you as a buyer’s agent is to position you for the  best deal possible on the house matching your interest.


My responsibility to you when selling your house is to provide  you with solid pricing information based on your time table and need to  sell.

In many buyers’ minds, they can see their furniture in this house. Already, they’ve made it a home, even before the ink dries on the offer.  
This is where the buyer’s real estate agent owes it to the buyer to stand up and allow logic to intercept emotion…for just a moment. When house hunting, you really can apply logic and emotion to your choice.
Months and years later you will appreciate the house and your restraint…and that goes for NOT buying more house than you safely can afford. Just to be clear, what crashed Sarasota real estate market did not occur from buyers overbuying with subprime mortgages.
From the podcast, all buyers take heed to these 3 home-buying tips…before getting shocked.
Don’t fall for some realtors’ scarcity chatter. Some realtors are so  desperate for a pay day, they contribute to the emotional “buy now; buy  this one” monologue.

Sarasota Foreclosures Face NEW Challenge!
Description: Sarasota foreclosures prompt FDIC to evaluate  “principal reductions” as strategic defaults blow up.

Contempt for subprime and NINJA loan homeowners – you know, those “bad” people who bought too much house and crashed the market and economy.
That’s all I used to hear from armchair quarterbacks and holier-than-thou types.
Today, subprimes and NINJA loan indignation has moved to contempt for principal reductions.
Principal reductions destroy/save the housing market and economy! (?)
Oh yeah, principal reductions – the latest foreclosure prevention discussion (long overdue IMHO) – is causing spontaneous combustion with some individuals, it’s reported.
In a nutshell, principal reduction is exactly what it sounds like: you owe $500,000. Your property is worth $300,000. To keep you in the house paying something (rather, what the property is worth today), your debt owner forgives $200k.
Aside from who qualifies, what I have heard is that you can’t turn around &amp; sell to gain this reduction. To get full reduction, you cannot sell for 3-5 years.
Once you push yourself through the venom spewed by the righteous, indignant crowd, you quickly find yourself asking questions:

Who’s eligible for a principal reduction?
Why shouldn’t EVERYONE with a mortgage that’s underwater get principal reduced?
How will fraud be controlled?

Before BOA (followed by other big-name banks) publicly announced principal reductions, I have been involved with negotiating principal reductions…off the radar. Quietly,  forward-thinking “debt owners” have been offering principal reductions for some time…but not publicly announcing it.
In fact, I support principal reductions, though I clearly see THE  fairness issue. I also see exactly why other people current and able to pay on their mortgage screaming,  “What the hell? I want my mortgage reduced. I will default if that’s what it takes!”

Description: Sarasota real estate exposes 3 common but costly home-buying MISTAKES, destroying John’s planned move to Sarasota.

Blind trust destroys planned move to Sarasota, Florida!
John’s enthusiasm and blind TRUST got ahead of him.
He blindly trusted a mortgage person who made promises he shouldn’t have made.
John and his family in New York already had scheduled movers…before John even had picked out a Sarasota home for sale. Don’t you think John got a little (or A LOT) ahead of himself?
By no means is this an attack on John.
Instead, this is a wake-up call to every one wanting to buy a house.
Emotion beats logic (nearly) every time….
Don’t emotionally attach to a house or schedule movers until you have dotted all i’s and crossed all t’s:

Work only with an experienced, proven &amp; trusted mortgage professional. Especially today, you can’t afford to choose a mortgage person just because you “like” the way he/she sounds on the phone. More and more fall-throughs (that is, closings not happening) occur because of an inexperienced and/or desperate mortgage person. YES, the same goes for real estate agents too, though real estate agents do not cause mortgages to fall-through.
Work only with an experienced real estate agent who’s willing to tell you the FACTS about a house and market, even if it means prolonging your house hunting. YEP, I’ve heard from friends and strangers who admit feeling pressured to buy, only later to regret and resent…ALL REAL ESTATE AGENTS!

Whenever I think of John, I think of the utter shock and confusion when he acknowledged “his guy” couldn’t get him financed. This was not about any kind of “I told you so, John.”
Rather, this is about John and his wife’s planned move to Sarasota. John and his wife eagerly looked forward to the new job (and life) in Sarasota.
Start with a trusted, proven mortgage professional, whether mortgage  broker or bank loan officer. I know of trusted, proven mortgage  professionals who can work all 50 states. HOWEVER, I will not recommend  just one mortgage professional if you ask me, nor do I have any financial arrangement  with any mortgage professional. I do, however, want you to find your  dream house AND close on it…so I can get paid for my work. I won’t hide the fact I want to be paid for my work. You don’t  close and we’re both up the creek w/o the proverbial paddle. You’d  better believe I want you to have the BEST mortgage professional out  there. I don’t care who she/he is, only that she/he gets you the  keys!

3 LETTERS (MLS) = MUCH COSTLY CONFUSION

What is “MLS”?

MLS or Multiple Listing Service is a searchable database of ALL properties listed for sale…by all listing agents and real estate companies.
What “misconceptions” hurt home buyers &amp; sellers?
When it comes to Sarasota MLS or any MLS, I hear all kinds of questions. However, the questions I don’t hear include 4 very common misconceptions about MLS search options.

Number 1 misconception: Internet listing sites such as Trulia, Zillow &amp; all other national sites OFFER ALL LOCAL listings. Typically, these national sites do NOT have access to ALL local listings. Are you aware of this?

Let me ask you, if you’re searching for your new home, would you like to know of ALL homes for sale? I would think so.
NOTE: Beware these national listing sites showing you what your house or a house is worth. Their values are proven over and over again to be OFF THE MARK (by a few $1,000s or many $1,000s). Buyers and sellers are concerned when they confirm this for themselves.

Number 2 misconception: You HAVE TO call the realtor or real estate company listing the house you want to see. As a buyer, you can work with any real estate licensee you want, even if it’s the same person listing the property.

Constantly, I’m surprised that many people think they must work with the agent listing the property. For your information, any agent you choose to help you buy a house has access to all Sarasota properties listed for sale. You can choose any agent you want to work with you.

Number 3 misconception: Realtors who force you to register before you can search MLS want to harass you to buy or sell using them as your realtor. I don’t agree with forced registration…but I don’t see realtors harassing people either.

Often, they simply want to email you additional information they believe will help you.

Number 4 misconception: Searching MLS on a company’s or real estate agent’s website shows ONLY that company’s or agent’s listings. Not so.

At least on my website at Sarasota MLS, you freely can search the entire MLS. By entire, I mean Sarasota south to Punta Gorda; north to Tampa; &amp; east to Orlando and all surrounding areas including Bradenton, Longboat Key, Siesta Key &amp; Lakewood Ranch.
You can search to your heart’s desire.
These are ALL properties listed with EVERY realtor’s and EVERY real estate company’s listings.
No doubt, the Internet empowers buyers and sellers—you have LOTS of opportunities to get informed about buying and selling.
